1. Acceptance of Terms

By accessing thebigyap.com or using the Audio Center desktop application, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Pro License & Subscription

Audio Center Pro is offered as a monthly subscription. Upon successful payment, you receive a license key that unlocks Pro features in the Audio Center desktop app.

• Your license is valid for the current billing period and renews monthly unless cancelled.
• Pro features are locked once a license expires. The app checks your subscription status periodically using the license key and device identifier.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued unless required by applicable law.
• License keys are issued per subscriber and must not be shared, resold, or distributed.

3. Revocation

BigYap reserves the right to revoke a license key immediately and without refund if:

• The key is found to be shared with or used by persons other than the original purchaser.
• The subscription payment fails or is charged back.
• We detect abuse, circumvention of license enforcement, or violation of these Terms.

4. Permitted Use & Recording Laws

Audio Center is a tool for recording audio on your own computer. You are solely responsible for ensuring your use of the app complies with all applicable local, state, national, and international laws.

You must not use Audio Center to:

• Record conversations, calls, or audio content without the knowledge or consent of all parties where required by law.
• Intercept communications in a manner prohibited by wiretapping, eavesdropping, or electronic surveillance laws.
• Record audio for any illegal purpose.

Many jurisdictions require "all-party consent" before recording a conversation. It is your responsibility to understand and comply with the laws of your jurisdiction. BigYap accepts no liability for your failure to do so.

5. Intellectual Property

The Audio Center app and BigYap website are owned by BigYap and protected by applicable intellectual property laws. You may not reverse-engineer, decompile, or redistribute any part of our software.

6. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or meet your specific requirements.

7. Limitation of Liability

To the maximum extent permitted by law, BigYap and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use our services, even if advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount paid by you to BigYap in the twelve (12) months preceding the claim.

8. Changes to These Terms

We may revise these Terms at any time. Continued use of our services after changes are posted constitutes your acceptance of the updated Terms. We will endeavour to provide reasonable notice of material changes.

9. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
